Terms of Use

The following terms of use, together with any documents and/or additional terms they expressly incorporate by reference (collectively, the "Terms of Use") govern your access to and use of: (a) our website available at https://www.thecanadianhome.com (the "Website"), our web application (the "The Canadian Home Realty Inc. Web App") and mobile application titled The Canadian Home (the "The Canadian Home App") including any content and functionality (collectively, the Website, the The Canadian Home Web App and the The Canadian Home App are "The Canadian Home"); (b) any text, pictures, media, data, information, materials and other content (collectively, the "Content") contained on or provided through (a); and (c) all other products or services provided by us to you on or through The Canadian Home (collectively, the "Offerings").

These Terms of Use form an agreement between The Canadian Home and our subsidiaries ("The Canadian Home", "us", "we", "our") and you. The term "you" or "User" refers to the person or entity browsing, installing, downloading, accessing or otherwise using The Canadian Home.

By using The Canadian Home in any way or by clicking to accept the terms and conditions, you represent and warrant that -

(a)   You have reached the legal age of majority in your jurisdiction,

(b)   You have the capacity to get into binding obligations, and

(c)   All information provided by you to us through the Canadian Home is true and accurate and agree to be bound by and comply with these terms of use, as updated from time to time.

(d)   After the Terms of Use agreement is opened for viewing, a “mouse click” is sufficient to acknowledge agreement to those terms.

(e)   The Canadian Home assumes no responsibility for the accuracy of any information shown on the website and mobile app.

(f)   All data obtained from the VOW (Virtual Office Website) is intended only for your personal, non-commercial use.

(g)   Have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the VOW.

(h)   Board/Association warrants the ownership of and the validity of the copyright in the MLS® database.

If you do not agree to these terms of use, you must not access or use The Canadian Home.

If you are using the Canadian Home on behalf of another person or a corporate entity, you represent and warrant that you have the authority to bind such person or entity to these terms of use.

These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with us in respect of any Offerings.

Account Access

(a)   To access certain sections of The Canadian Home, you may be required to successfully sign up for a user account using the available interfaces of the services and establish login credentials.

(b)   We reserve the right to disable any User at any time in our sole discretion. If we disable access to a User, you may be prevented from accessing The Canadian Home (or any portion thereof).

(c)   The Canadian Home is entitled to act on instructions received through your account. The Canadian Home is not responsible for any actions taken or transactions made to or from your account by any other party using your account. You are solely responsible for any and all use of your user account and all actions and activities that occur under or in connection with it. Without limiting any rights which we may otherwise have, we reserve the right to take any and all action, as we deem necessary or reasonable, to ensure the security of The Canadian Home and your account, including without limitation terminating your account or changing your password.

Listing Data

The Canadian Home does not assert copyright or grant any rights to the images associated with or descriptions of listings provided through the Services. Any use of such images and descriptions is subject to the permission of the copyright owner and the requirements of applicable law.

All MLS® data obtained from the Services ("Listing Data") is intended only for your personal, non-commercial use and is being provided to you because you have a bona fide interest in the purchase, sale, or lease of residential real estate being offered through the Services.

You agree you will not copy, redistribute, retransmit, or otherwise use any of the data or Listing Data provided, except in connection with your consideration of the purchase, sale, or lease of an individual property.

Further, Listings Data may not be modified or altered in any respect, merged with other data or published in any form, in whole or in part, including by way of "screen scraping", "database scraping" and any other activity intended to collect, store, reorganize, summarize or manipulate any Listings Data available through the Services.

You acknowledge the Toronto Real Estate Board’s ("TREB") ownership of and the validity of TREB's proprietary rights and copyright in the MLS® database, MLS® data, TREB's MLS® System, and Listing Data.

You further acknowledge that these Terms of Use also expressly authorizes TREB, and other TREB Members or their duly authorized representatives, to access the Services for the purposes of verifying compliance with MLS® Rules and Policies (including those governing the Services) and monitoring the display of Listing Data through the Services. In accordance with our Privacy Policy, you consent to the fact that your personal information, including first and last name, email address, and phone number may be collected, used or disclosed for such purpose and this personal information may be shared with TREB for auditing and/or legal purposes.

The content on this website is protected by copyright and other laws, and is intended solely for the private, non-commercial use by individuals. Any other reproduction, distribution or use of the content, in whole or in part, is specifically prohibited. Prohibited uses include commercial use, “screen scraping”, “database scraping”, and any other activity intended to collect, store, reorganize or manipulate the content of this website.

You Acknowledge:

(i)   That the Canadian Real Estate Association (CREA) is the owner of the REALTOR® and MLS® trademarks: REALTOR®, REALTORS®, and the REALTOR® logo are certification marks that are owned by REALTOR® Canada Inc. and licensed exclusively to CREA. These certification marks identify real estate professionals who are members of CREA and who must abide by CREA's By- Laws, Rules, and the REALTOR® Code. The MLS® trademark and the MLS® logo are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA.

(ii)   The Toronto Regional Real Estate Board (TRREB)'s ownership of, and the validity of TRREB's proprietary rights and copyright in, the MLS® database, TRREB's MLS® System, TRREB's listing information and any related data.

(iii)   The Information Technology Systems Ontario (ITSO)'s ownership of and the validity of ITSO's copyrights in the MLS® System data.
